Terms of Use

These Terms of Use (the “Terms”) govern your use of the mobile game application Cherry Sum, including its game content, features, advertisements, and related services (collectively, the “Services”), provided by Koh Kobayashi (“we,” “us,” or “our”).

By downloading, installing, launching, accessing, or using the Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Services.

1. Eligibility and Minors

• You may use the Services only if you agree to these Terms and comply with all applicable laws and platform rules.
• If you are a minor under the laws of your country or region, you must obtain permission from your parent or legal guardian before using the Services.
• Parents and legal guardians are responsible for supervising a minor’s use of the Services, including the minor’s viewing of advertisements and use of rewarded-ad features.

2. Description of the Services

• Cherry Sum is a puzzle game in which users solve number-based puzzles and progress through stages and ranks.
• The Services may include:
• Randomly generated puzzles;
• Stage and rank progression;
• Hints;
• Local save data;
• Sound effects and background music;
• Interstitial advertisements;
• Rewarded advertisements; and
• Other game-related features added through updates.
• The difficulty, rules, puzzle-generation methods, number of stages, ranks, visual design, sound, advertisements, and other elements of the Services may be changed, adjusted, added, or removed through updates.

3. License to Use the Services

• Subject to your compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, and revocable license to use the Services for your private, non-commercial entertainment.
• This license does not transfer ownership of the Services, game content, software, designs, images, sounds, music, text, user interfaces, or any other materials to you.
• You may not use the Services for commercial purposes unless you have received our prior written permission.

4. Local Game Data

• Cherry Sum does not currently require user account registration.
• Game progress, stage information, rank information, sound settings, and other game data may be stored locally on your device.
• The Services do not currently provide an independent account system, online ranking system, or developer-operated cloud-save system.
• Local game data may be lost, reset, corrupted, or become unavailable due to:
• Deleting or reinstalling the app;
• Clearing app data;
• Changing or losing your device;
• Operating system updates;
• Device failures;
• Storage failures;
• App updates;
• Software bugs; or
• Other circumstances beyond our reasonable control.
• We do not guarantee that game data can be restored, transferred, recovered, or retained indefinitely.
• You are responsible for managing your device and any backup functions provided by Apple, Google, or your device manufacturer.

5. Advertisements

• The Services may display advertisements provided through Google AdMob or other third-party advertising services.
• Advertisement formats may include:
• Interstitial advertisements;
• Rewarded video advertisements; and
• Other advertising formats supported by the applicable advertising provider.
• Interstitial advertisements may be displayed at appropriate points during gameplay, such as after certain play-time or game-progress conditions are met.
• Rewarded advertisements may be offered in exchange for optional in-game benefits, including:
• Receiving a hint; and
• Reviving with one remaining life after a Game Over.
• Rewarded advertisements are optional. You are not required to view a rewarded advertisement unless you wish to receive the associated in-game benefit.
• An advertisement or reward may fail to load, display, complete, or be granted due to:
• Network conditions;
• Lack of available advertisements;
• Advertising-provider failures;
• Device or operating-system restrictions;
• App-store restrictions;
• Fraud-prevention systems;
• Advertisement interruptions; or
• Other technical or operational reasons.
• We do not guarantee that an advertisement will always be available or that an in-game reward will always be granted.
• Advertisements and external services accessed through advertisements are provided by third parties and may be subject to their own terms and privacy policies.
• We do not endorse or guarantee the accuracy, legality, safety, quality, availability, or suitability of any product, service, website, or application promoted through an advertisement.
• You must not engage in fraudulent advertisement viewing, automated advertisement interaction, invalid traffic generation, false installations, reward abuse, or any other misuse of advertising systems.

6. No Paid Features

• Cherry Sum does not currently offer paid features, subscriptions, in-app purchases, paid virtual items, or paid advertisement-removal features.
• We may introduce paid features in the future. If paid features are introduced, the applicable price, conditions, purchase method, cancellation rules, refund rules, and platform requirements will be displayed separately before purchase.
• Any future purchases made through the Apple App Store, Google Play, or another payment platform will also be governed by the terms and procedures of that platform.

7. Prohibited Conduct

You must not engage in any of the following conduct:

• Violating applicable laws, public order, these Terms, app-store rules, or third-party service terms.
• Using the Services for unlawful, fraudulent, harmful, or abusive purposes.
• Exploiting bugs, errors, vulnerabilities, or unintended game behavior.
• Modifying, tampering with, falsifying, or manipulating:
• Game data;
• Stage progress;
• Rank progress;
• Puzzle data;
• Scores;
• Advertisement rewards; or
• Local save data.
• Cheating, hacking, reverse engineering, decompiling, disassembling, analyzing source code, bypassing technical restrictions, or attempting to derive the internal operation of the Services, except where such restriction is prohibited by applicable law.
• Using bots, macros, scripts, automation tools, crawlers, scraping tools, or similar methods to operate or analyze the Services without our permission.
• Interfering with or disrupting the Services, advertisements, app-store functions, devices, networks, systems, security features, or third-party services.
• Introducing viruses, malware, malicious code, or harmful software.
• Impersonating another person or falsely representing your relationship with us.
• Infringing copyrights, trademarks, privacy rights, publicity rights, or any other rights belonging to us or a third party.
• Copying, reproducing, distributing, selling, licensing, modifying, publishing, or commercially exploiting the Services or their content without permission.
• Using the Services or their content to create or distribute unauthorized copies, competing products, cheat tools, or substantially similar commercial services.
• Fraudulently obtaining advertisement rewards or interfering with advertisement systems.
• Making false, abusive, threatening, repetitive, or excessive inquiries.
• Engaging in any other conduct that we reasonably consider harmful to the operation, security, integrity, or reputation of the Services.

8. Measures Against Violations

• If we reasonably determine that you have violated or may have violated these Terms, we may take measures including:
• Restricting access to the Services;
• Invalidating game data or rewards;
• Resetting game progress;
• Restricting certain features;
• Preserving relevant logs or evidence;
• Reporting fraudulent activity to advertising providers, app stores, platform operators, law-enforcement authorities, or other appropriate parties; and
• Taking any other reasonable action necessary to protect the Services or third parties.
• We are not responsible for losses resulting from measures taken under this Section, except where liability cannot be excluded under applicable law.
• If your violation causes damage to us or a third party, you may be responsible for that damage to the extent permitted by law.

9. Intellectual Property Rights

• All intellectual property rights and ownership rights relating to the Services belong to us or the applicable lawful rights holders.
• Protected materials include, without limitation:
• Game software;
• Puzzle-generation systems;
• Game rules and presentation;
• Images;
• Icons;
• Sound effects;
• Music;
• Text;
• Designs;
• User interfaces;
• Logos;
• Data; and
• Other game content.
• You may not use these materials beyond the scope permitted by these Terms or applicable law.
• You may post ordinary screenshots or gameplay recordings for personal, non-commercial reviews, commentary, social-media posts, or gameplay videos, provided that your use:
• Does not violate applicable law;
• Does not infringe third-party rights;
• Does not falsely imply official sponsorship or endorsement;
• Does not promote cheating or unauthorized modification; and
• Does not otherwise harm the Services or their reputation.

10. Third-Party Services

• The Services may rely on or interact with third-party services, including:
• The Apple App Store;
• Google Play;
• Google AdMob;
• Operating-system services;
• Device backup services; and
• Other technical service providers.
• Your use of third-party services is governed by the terms, privacy policies, rules, regional restrictions, and technical requirements of those third parties.
• We do not control and are not responsible for:
• Third-party service availability;
• Advertisement availability;
• Platform outages;
• Store-review decisions;
• Device-backup behavior;
• Operating-system restrictions;
• External websites;
• Advertisement content; or
• Changes to third-party specifications.
• Changes, failures, suspension, or termination of third-party services may affect all or part of the Services.

11. Updates, Changes, and Discontinuation

• We may update, modify, add, suspend, or discontinue all or part of the Services when reasonably necessary.
• Changes may include:
• Game balance adjustments;
• Puzzle-generation changes;
• Difficulty changes;
• Stage or rank changes;
• Advertisement-frequency changes;
• Design changes;
• Sound changes;
• Supported-device changes;
• Supported-operating-system changes;
• Bug fixes;
• Security updates; and
• Legal or platform-compliance changes.
• We may temporarily suspend the Services due to maintenance, technical failures, network problems, security concerns, legal requirements, app-store requirements, natural disasters, or other circumstances beyond our reasonable control.
• We do not guarantee that the Services will remain available indefinitely.

12. Privacy

• Information relating to your use of the Services will be handled in accordance with our Privacy Policy.
• The Services may involve the processing of information by third-party advertising providers, including Google AdMob.
• Advertising identifiers, device information, advertisement-interaction information, and similar information may be processed by advertising providers in accordance with their privacy policies and applicable platform settings.
• Please review the Privacy Policy before using the Services.

13. Disclaimer of Warranties

• The Services are provided on an “as is” and “as available” basis.
• To the extent permitted by applicable law, we do not warrant that:
• The Services will always be available;
• The Services will be uninterrupted or error-free;
• All generated puzzles will have a particular difficulty or structure;
• All devices or operating-system versions will be supported;
• Game data will never be lost;
• Advertisements will always be available;
• Rewarded-ad rewards will always be granted;
• The Services will meet your individual expectations; or
• Bugs, defects, delays, or security issues will never occur.
• Because puzzles may be randomly generated, their structure, appearance, number of blank cells, and difficulty may vary.
• We may modify generated puzzles, game rules, progression, balance, or difficulty to improve the Services.

14. Limitation of Liability

• To the extent permitted by applicable law, we are not liable for damages arising from:
• Your use of or inability to use the Services;
• Loss, corruption, or reset of local game data;
• Device failure;
• App deletion or reinstallation;
• Network failure;
• Advertisement failure;
• Failure to receive an advertisement reward;
• Third-party services;
• Operating-system changes;
• App-store actions; or
• Suspension, modification, or termination of the Services.
• Where we are legally liable, our liability will be limited to direct, ordinary, and actually incurred damages to the extent permitted by law.
• To the extent permitted by law, we are not liable for indirect, incidental, special, consequential, punitive, or economic damages, including lost profits, lost opportunities, or loss of data.
• Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited, including liability arising from our intentional misconduct or gross negligence where applicable.

15. User Responsibility

• You are responsible for:
• Your use of the Services;
• Your device;
• Your network connection;
• Compliance with applicable laws;
• Compliance with app-store rules;
• Supervision of minors under your control; and
• Any consequences arising from prohibited conduct.
• If your intentional or negligent violation of these Terms causes damage, claims, costs, or disputes involving us or a third party, you may be responsible for such damage to the extent permitted by applicable law.

16. Changes to These Terms

• We may revise these Terms when reasonably necessary due to:
• Changes to the Services;
• Changes in applicable laws;
• Changes in app-store requirements;
• Changes in advertising services;
• Security requirements; or
• Operational reasons.
• Revised Terms and their effective date may be presented through the app, an official webpage, the applicable app-store listing, or another reasonable method.
• If you continue to use the Services after revised Terms take effect, you will be deemed to have accepted the revised Terms.
• If you do not agree to revised Terms, you must stop using the Services.

17. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions will remain in full force and effect.

18. No Waiver

Our failure or delay in exercising any right under these Terms does not constitute a waiver of that right.

19. Assignment

• You may not assign, transfer, or otherwise dispose of your rights or obligations under these Terms without our prior written consent.
• We may transfer our rights and obligations under these Terms in connection with a transfer of the Services, business succession, merger, reorganization, or similar transaction, in accordance with applicable law.

20. Governing Law and Jurisdiction

• These Terms are governed by and construed in accordance with the laws of Japan.
• Any dispute arising from or relating to the Services or these Terms will be subject to the exclusive jurisdiction of the Japanese court having jurisdiction over the location of the developer as the court of first instance, except where otherwise required by applicable consumer-protection laws or other mandatory laws.
